December 29, 2015 by the State Committee for the Protection cultural heritage of the Republic of Crimea (hereinafter referred to as the Committee), contracts were concluded for the implementation of emergency response, repair and restoration work for 16 architectural monuments for 1 billion 73 million rubles.

Six contracts were awarded to the St. Petersburg company OOO Korinf, three to OOO ArkhStroyCompany, and seven more to Corporation ATTA Group. During the year, they had to study the monuments, propose and agree on emergency response projects and carry them out.

By the summer, the design and estimate documentation was ready. The committee agreed on the projects, after which the documents had to undergo an examination of the estimated cost. But it turned out that there was no place in Crimea to conduct a state examination of documents for restoration work, and only after a three-month leapfrog, the State Construction Expertise in Simferopol agreed to do it.

While Corinth was waiting for the results of the examination for three months in order to finally start emergency response work, thunder struck.

On October 21, 2016, Corinth received a letter from the Committee on a unilateral refusal to perform and termination of the contract from October 10, dated September 30, 2016.

On the same day, October 21, the head of the Republic of Crimea issued an order: a new procurement will take place for all facilities where Korinth and ArchStroyCompany have been working for nine months

A week later, the sole supplier ( total amount contracts for these two companies - 561.4 million rubles) was the St. Petersburg LLC "Meandr". The contract stipulated the same work and the same amounts as in the contracts of previous contractors.

“We consider the termination of contracts unreasonable, but most importantly, the result of the work of our team is shamelessly denied,” says Igor Burdinsky. - In the contract with Meander, the deadline for completion of work is December 25, 2016. It is impossible to complete in two months research work, which we have done, create design and estimate documentation, go through the approval procedure prescribed by law, and then carry out the work itself! At first we did not understand why Meander agreed to these impossible conditions, but then we came to the conclusion that their actions were planned with the participation of the committee.

"It's obvious to the state customer"

The contract termination letter says: “As of September 30, 2016, the work under the contract has not been completed and it is obvious to the State Customer that the work will not be completed.”

In "Korinth", in turn, they are sure that the delay is due to the failure of the committee to fulfill its duties - officials could not send documents for examination for three months. And the lack of access to the SRO - another accusation - does not interfere with the conduct design work. This permit is issued in a little more than a week.

Moreover, according to the law "On contract system» the customer is obliged to issue a unilateral termination of the contract by a decision, and the contractor has ten days to object or eliminate violations. Corinth was notified of the termination of the contract after the fact, without even specifying whether the decision required by law had been made, which could be challenged in court.

Thus, Corinth, in principle, did not receive the legal opportunity to defend its rights.

Arriving in the Crimea, Burdinsky discovered that the house in Simferopol was no longer leased by Corinth - since September, Meander has been the tenant, and Nikolai Sivozhelezov also moved to work for this company. Burdinsky could not get into the building to pick up the documents of his company.

On November 8, the director of Korinf went to Gosstroyekspertiza to pick up the design and estimate documentation made by his company. There he was told that no contracts had been concluded with the committee for the study of these documents, and therefore they could not issue the documentation. The next attempt to collect the results of the work Burdinsky made three days later. And I found out that the day before, on November 10, all the documents were issued to ... Sivozhelezov.

“How could they issue our documents to a person who no longer works for us? - says the director of Corinth. “Gosstroyekspertiza told me that they did it by direct order of the deputy chairman of the committee, Alexander Didenko.”

Burdinsky made sure that the State Construction Expertise gave him a certificate, which, in his opinion, proves that local officials acted exclusively in the interests of Meander. It says in black and white: “On November 10, 2016, at the request of the Minister of Culture of the Republic of Crimea and the Deputy State Committee for the Protection of the Cultural Heritage of the Republic of Crimea, Didenko A.E., the design and estimate documentation of Korinf LLC and ArchStroyCompany LLC was handed over to the authorized person Sivozhelezov ON THE.".

That is, the deputy chairman of the committee, Didenko, ordered that documents belonging to Corinth be handed over to an employee of Meander. There were no agreements between the companies for the sale of documents. However, now "Meander" (if Sivozhelezov, of course, did not throw the result of many months of work into the ditch) has a package of documents necessary to start work, for which no one is going to pay Corinth a penny.

Burdinsky believes that the papers were given to Sivozhelezov in the interests of Meander, who would not be able to meet the deadlines established by the contract without them. He intends to apply for initiation on this fact criminal case.

Meanwhile, the committee acknowledged that it would not be possible to complete the work on time: “We will not use the funds allocated under this program by the end of the year,” Didenko said in mid-November at a meeting of the State Council of Crimea.

Corinth applied to the court of Simferopol with a claim to challenge violations in the purchase from a single supplier; next in line are claims to challenge the termination of contracts and damages.

We are writing to you in connection with the problem of preserving the ensemble of the Krasnoye Znamya factory, which was designed by the outstanding architect Erich Mendelssohn and has a global cultural value. Below are the facts that need to be taken into account at today's council meeting (it took place on March 20).

The architectural concept of adaptation for modern use of the dominant architectural ensemble of the Krasnoye Znamya factory - the CHP building - proposed today for discussion by the members of the Council, was made in complete disregard for the approved security obligation No. 40-4 of February 1, 2016 and is a project with flagrant violations of the subject of protection monument. In this regard, the issuance this issue on advice is unauthorized.

The act based on the results of the historical and cultural expertise dated February 9, 2017, specifying the objects of protection of the cultural heritage object of regional significance “CHP of the Krasnoye Znamya Factory”, executed by expert M.S. Stieglitz, contains gross errors, as well as unreliable information about the object. Thus, the approval of this examination is unacceptable.

The public initiative group sent objections to the conclusions of the above examination to KGIOP, which were officially accepted by the committee.

Analysis of two historical and cultural examinations performed by the expert M. S. Stieglitz on objects located on the territory of the Krasnoe Znamya factory, in which conclusions are drawn regarding the building of the CHPP of the Krasnoe Znamya factory (dated September 25, 2015 and February 9, 2017), revealed differences in historical facts and inconsistencies in the findings.

These inconsistencies indicate the expert's dishonest and arbitrary attitude towards the preservation of objects of outstanding value.

Arguments and materials confirming the above statements were sent to the Ministry of Culture of the Russian Federation, on the basis of which the public initiative raises the issue of depriving expert MS Stieglitz of accreditation.

The declared plans for the restoration of the facades of the monument for the football championship demonstrate absolute incompetence and a lack of understanding of the problems of concrete sanitation. The desire to ensure the appearance of the preservation of the object in such a short time is dangerous for the building, the planned work has nothing to do with the concept of "restoration" and contradicts the principles of dealing with objects of national cultural heritage.

When making decisions regarding the Krasnoye Znamya factory, it is necessary to take into account the critical importance of this architectural ensemble for Russian-German cultural ties. In 2009, within the framework of the Russian-German forum "Petersburg Dialogue", a resolution was signed on the complete preservation of this architectural ensemble. Also, in the working documents of the forum, the object is considered as a unifying factor in the history of relations between Russia and Germany.

German experts invited to the round table on the preservation of the Krasnoye Znamya factory stated the unacceptable treatment of historical territory factories. According to the results of the visit of German specialists to the facility and familiarization with the concept of adaptation for modern use of the ensemble's dominant - the CHPP building - documentation is being prepared. And, according to their statement, a protest from the international expert organizations DOCOMOMO and ICOMOS will be sent in the near future.

Dear council members! An unchanging, unshakable condition for determining the future function for such a significant architectural monument is to ensure the historical authenticity of the object, namely the absolute preservation of the internal and appearance building. The expertise he writes about was carried out by the Northwestern Association of Historical and Cultural Research and Expertise LLC and entered the KGIOP on February 14, 2017. On February 21, 2017, it was withdrawn by the customer of the examination, LLC Mendelson, since the expert M. S. Stiglitz discovered serious technical omissions and errors.
